POLI 439 Selected Topics in Public Law Children and 3 credits
the Law
Grade Method: REG/P-F/AUD In this class we
will study the interaction between the
state and children. we will examine how
the legal system and institutions of
government treat children and how they
handle legal issues associated with child
custody, care and support. The course
surveys the evolving policies on issues
such as child labor, foster care and
adoption as well as the evolution of
juvenile courts. Through reading case law,
policy papers and articles, the class will
look at the legal rights of children, the
legal political issues associated with
family, and the policies behind the
applicable laws. Specifically, the class
will consider topics such as children's
constitutional rights in public school,
children's rights in the criminal setting,
termination of limitation of parental
rights by state, and a child's right to
make binding decisions. The class will
strive to resolve such questions as when
the state has the right to intervene in
family decisions, whether children should
be afforded the same constitutional rights
as adults, and under what circumstances a
child should be treated as as an adult.
